Privacy Policy of WHIZ

1. General

1.1. WHIZ gives utmost importance to the protection of personal data of its customers. WHIZ is duly registered as a personal data administrator with the Commission for Personal Data Protection under number 383665 / 31.07.2013 and all customer data is collected, transferred and maintained in accordance with the principles incorporated within the Data Protection Act of the Republic of Bulgaria (PDPA) and the EC Directive 95/46 on the protection of personal data. The personal data regarding the Client that is provided by the Client as well as by third parties such as state and international authorities, which have competence in the prevention of frauds, is preserved in electronic form in personal data registers with communication coverage, security and control of access.

1.2. The Client has to read this Privacy Policy carefully in order to understand the views and practices of WHIZ regarding Client personal data, how it is used and how it is treated by WHIZ. If the Client disagrees with this Privacy Policy, the Client shall not use the services provided by WHIZ. By providing personal information to WHIZ and by maintaining contractual relations with WHIZ after Client has already obtained knowledge of this Privacy Policy, WHIZ will assume that the Client has consented to the collection, use and disclosure of personal information about the Client in accordance with the terms set out in this Privacy Policy unless the Client explicitly notifies WHIZ otherwise.

1.3. This Privacy Policy may be revised from time to time because new features may be added to the services of WHIZ or because of amendments in legislation or other legal reasons. WHIZ may amend this Policy at any time by posting a revised version on its Website. The revised version will be deemed effective from the moment of its publication. If the Client disagrees with the terms of this Privacy Policy, the Client shall terminate the use of the services.

2. Collection of Information

2.1. In order to use and the services of WHIZ the Client shall provide its corporate data and personal data of its representative. This required information is necessary for WHIZ to identify the Client and its legal status, to duly provide the services, for accounting and statistical purposes as well as for the purposes of marketing and advertisement of improvements in the services or launching of new services.

2.2. If the Client sends to WHIZ correspondence, including post mails, e-mails and faxes, WHIZ will retain such information in the record of the Client. WHIZ will also retain customer service correspondence and other correspondence from WHIZ to Client. WHIZ retains these records in order to assess and improve the provision of customer service, as well as to investigate potential violations of the terms of the services of WHIZ. In addition, phone calls of the Client reaching WHIZ and the other way around may be monitored and/or recorded for purposes of quality improvement of the service, as well as for purposes of security.

2.3. In order to fulfil its legal obligations to prevent illegal actions, including without limitation IP rights infringements and/or to protect all of its customers against potential losses, WHIZ may obtain information about Client from third party agencies, including financial history details, county court judgments and bankruptcies, from credit reference and fraud prevention agencies.

2.4. In addition to the personal information provided by the Client or obtained from third parties, WHIZ’s Website may use a technology which allows to WHIZ to gather particular technical information i.e. address of the Client’s internet protocol, operational system of the Client’s computer, the Client’s browser type, traffic data, location data, weblogs and other communication data, whether this is required by WHIZ for purposes of control of risk and security, performance of regular obligations, inventory or other purposes.

3. Provision of information and consents of the Client

3.1. By confirming the order for using a service the Client explicitly agrees in the meaning of Art. 4, para. 1, point 2 of the PDPA with the processing by WHIZ of all data provided by the Client or legally obtained by WHIZ for the above described purposes in the manner, specified in the present Privacy Policy and the effective legislation of the Republic of Bulgaria.

3.2. By providing an e-mail address and/or a phone number the Client grants its prior explicit consent in the meaning of Art. 6 of the Electronic Commerce Act to receive from WHIZ commercial messages, related to the service and/or other services provided by WHIZ and/or its partners.

4. Disclosure of Information

4.1. WHIZ will not sell or rent any of personal information about the client to third parties in breach of its legal obligations. WHIZ will grant access to the personal information relating the Client only to those employees who need it in order to provide the services of WHIZ. WHIZ may disclose personal information about the Client to any member of the group of WHIZ, which means subsidiaries of WHIZ, the ultimate holding company of WHIZ and its subsidiaries who are based in different countries within the EEA. This may be necessary to WHIZ in order to, among other things, fulfil requests of the Client, provide support services and monitor suspicious activities.

4.2. WHIZ will disclose information about the Client in the event that WHIZ is obliged by an effective law to do so. Such disclosure includes, without limitation, account information, personal information and the contents of communications to: the court; the police; security forces; competent governmental, intergovernmental or supranational bodies; competent agencies (other than tax related authorities), departments, regulatory authorities. If false or inaccurate information is provided by the Client and illegal action is identified, WHIZ will forward the details to fraud prevention agencies and law enforcement agencies may access and use that information. WHIZ and other organisations may also access and use this information (including information from other countries) to prevent fraud and money laundering.

5. Information Security and Protection

WHIZ assumes the responsibility to ensure that the information about the Client is protected. To prevent unauthorised access or disclosure of information WHIZ maintains physical, electronic and procedural safeguards that comply with applicable regulations to guard non-public personal information. WHIZ restricts access to personally identifiable information of the Client only to employees who need to know that information in order to provide products or services to Client.

6. Accessing and Changing Information by the Client

6.1. The Client can review the personal information which is provided to WHIZ and make any desired changes to such information by logging into the administrative panel at the Website, section “My Profile” and changing the respective configurations.

6.2. Upon request of the Client, WHIZ will inform the Client where the personal information of Client has been stored, what personal information WHIZ has about Client and for what purposes it is used it for by WHIZ. Such requests may be submitted to the Customer Service of WHIZ or by a regular mail to the post address of WHIZ as follows:
